Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to serious injuries from being struck by a JCB, All Terrain
fork truck which was
being operated in reverse gear and the reverse signal alarm could not be
heard above the
surrounding construction noise level at the new tank area of the site.
Among other methods,
feasible and acceptable methods to correct this hazard would be to install
a reverse signal alarm
which was louder than the surrounding noise levels, or to assign a spotter
who would direct the
operator that it was safe to back up.
(a)The JCB, All Terrain, fork lift truck, # 506 C-HL, Serial # 588689, was
equipped with
a reverse signal alarm, but it could not be heard over the construction
noise in the
construction areas of the new tanks.
