Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employmnent and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the potential hazard of being struck by lifting hoists and
appurtenances that had
not been rated and load tested and permanently marked, hooks were not the
latch type, loads
were not properly balanced to prevent slippage, hooks were obstructed
during lifts and sections
of chains and slings were tied together in order to make a lift.  Among
others, several feasible
and acceptable methods to correct these hazards are to engineer and
construct lifting devices in
accordance with manufacturer's recommendations, perform periodic
inspections, install latch
type hooks, train employees in proper rigging and loading techniques and
extend the lower end
of the downer ramp as referenced in ANSI B30.16-1973.
