Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees engaged in longshoring operations were exposed to the hazard of being struck by a falling crane boom and its load when a ship's cargo crane boom collapsed and dropped its load of aluminum "poles" weighing approximately 12.2 metric tons. Two employees (laborers) assigned by the foreman to work in the ship's hold rigging the aluminum "poles" to the crane rigged several bundles of aluminum "poles" weighing approximately 12.2 metric tons to the crane load line and the crane is rated with a safe working load of 10 metric tons (22,046.2 lbs) at 30 degrees. Among other methods, one feasible and acceptable abatement method is to train personnel to safely rig crane loads with respect to the crane's safe working load and the foreman and/or superintendent for longshoring operations shall give specific instructions to the riggers about the weight of the loads being hoisted.
