General-duty citation text
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that they were exposed to being struck by and crushed between the superstructure of an excavator and its tracks. Site: 1000 S. Rodney French Blvd., New Bedford, MA- West side of earth support cofferdam/excavation. Employees were walking and working next to the side and rear of the Komatsu Crawler Excavator while the machine was in operation. Among other methods, one feasible and acceptable abatement method to correct the hazard is to install a physical barrier or warning line around the swing radius of the excavator to prevent employee access into the danger area. This is an acceptable industry practice when the operator is not constantly repositioning the machine.
