Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to being struck by and crushed between the rotating
superstructure of the crawler
excavator and its tracks:
870 Hammond Street, Brookline, MA- jobsite:
The Insley Crawler Excavator hoisting bundles of rebar from a flat bed
truck was not equipped
with a swing radius barricade around the rear of the excavator's rotating
counterweight to
prevent employees from being struck by the excavator.
Among other methods, one feasible and acceptable abatement method to
correct the hazard is
to place highly visible warning signs on all three sides of the
excavator's counterweight
combined with an employee safety training program on working around
excavating
machines.
