Section 5(a)(1) of the Occupational Safety & Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that, employees were exposed to the hazards of having part of their body caught between the rotating superstructure and the wheelbase or being struck by the rotating superstructure. One feasible and acceptable method to correct this hazard is to install some type of moveable barrier such as stanchions with warning tape around the machine working section at an appropriate distance from the machinery that would warn employees that they are getting too close to the swing radius. Job Site: Premium Outlet Mall, Wrentham, MA A Somero Laser Screed S-240 machine had an unguarded swing radius exposing employees to possible serious injury from caught- between and struck-by hazards.y
