Section 88.4 - Code of Iowa (1997) 88.4: The employer did not furnish to each of the employer's employees employment, and a place of employment which was free from recognized hazards that were causing or likely to cause death, or serious physical harm to employees in that employees were exposed to unintentional actuation of the foot treadle of the Windmill Tailfin shear: (a)In the Shop Area - The windmill tailfin shear is operated by a foot treadle. The treadle is not protected from unintentional actuation. This could result in an employee being in the point of operation or material hold down area when the shear cycles. Among other methods, one feasible and acceptable abatement method to correct this hazard is to guard the foot control as required by ANSI B11.4 section 5.2.2.5.5(2) for shears..5(2)

Section 88.4 - Code of Iowa (1997) 88.4: The employer did not furnish to each of the employer's employees employment, and a place of employment which was free from recognized hazards that were causing or likely to cause death, or serious physical harm to employees in that employees were exposed to unintentionally cycling of shear: (a)In the Shop Area - The Windmill Tailfin shear is operated by a foot treadle. The return spring for the treadle is not a compression type spring. A broken spring of this type would not support the treadle. This could result in the machine cycling unintentionally when the operator is in the point of operation. Among other methods, one feasible and acceptable abatement method to correct the hazard is to install a compression type spring as required by ANSI B11.4 section 5.2.2.5.5(2)(b) for shears..5(2)(b)
