Section 88.4 - Code of Iowa (1999) 88.4: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to an undetermined load capacity: (a)In the Workplace - The employer took the mast off of an industrial truck, hydraulic hose, an electrical controller, a hydraulic control valve, and an electro- hydraulic fluid pump. These components were then assembled and mounted inside the building as a lift for materials. The lift was used to transport counter top components, weighing several hundred pounds and greater, to an upper floor. The components had not been tested and inspected as a unit. There was no determination as to the reasonable load capacity for this assembly. The modification to the unit had not been approved by the manufacturer or by a professional engineer. There was no provision for the system to fail safe in the event of power or fluid loss. An acceptable means to abate this deficiency would be to have a licensed, professional engineer evaluate, test, and modify this assembly so that it can safely handle a rated load. Compliance with the design requirements of ASME A17.1-1996 or ANSI A10.5-1981, safety code for elevators and escalators and safety requirements for material hoists respectively, could meet this requirement. This deficiency was noted on or about 10-07-99.

Section 88.4 - Code of Iowa (1999) 88.4: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to unnecessary strain and damage to conduit: (a)In the Basement - Flexible metal conduit was used to provide electrical power for a hydraulic pump. The conduit ran approximately 6.5'-7' from an overhead junction box down to the pumps' motor. The conduit was not supported for this distance. This increased the potential for unnecessary strain and damage to the conduit. An acceptable means to abate this condition is to secure the conduit, at least, every 4.5' and within 12" on each side of an outlet box, junction box, cabinet, or fitting. This is in accordance to the National Electric Code 350-4, concerning support for flexible metal conduit. This deficiency was noted on or about 10-7-99.cy
