Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) The hazard of being struck by a falling Demag D46 diesel powered hammer. Employee(s) were engaged in a welding test whereby conductive pipe casing was being hammered into the ground using the hammer with test welds done on the piping. The hammer, which weighed 34,000 lbs., was suspended by a 5/8" load line from a Link Belt pedestal crane (serial number 7DBT2276) by means of a spreader bar and two slings. The cable suddenly broke causing the hammer to fall striking an employee. The operation occurred in the Mar-Con Inc., yard at 5524 Veterans Memorial Hwy, Erath, La. Among other methods, one feasible and acceptable abatement method to correct this hazard is to perform monthly running cable inspections and maintain a record of the inspection.
