Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to:
(a) Being struck by a falling pipe, caused from breaking a "tremmie" pipe
by striking it
against a crane and by having employees in the fall radius of the raised
pipe. Among other
methods, one feasible and acceptable method is to have crane operators
raise the "tremmie" pipe
slowly so that it doesn't strike the crane and by having employees stay
out of the fall radius of
the raised "tremmie" pipe until it is safe to reenter."
