Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to:
(a)  The hazards of collisions and falls resulting from the following:
1)  Faulty dock levelers in the shipping and receiving areas, which
unexpectedly pop up, creating an uneven surface between the
trailer and dock.  Drivers could lose control of the vehicle while
driving over the uneven surface.
2)  The dock lips did not fully extend to the trailer bed as intended
by the manufacturer.  Employees had to manually hold up the dock
lip as the dock was lowered from the raised position, exposing
employees to the hazards of falls while standing on the uneven
surface.
Among other methods, one feasible and acceptable method of abatement would
be to adjust the
dock leveler Lip Assist Spring and Main Torsion Bars as per the
manufacturer's
recommendations and to schedule the inspection and maintenance of the dock
levelers on a
recurring basis.
