Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to:
(a)  the hazards of accidents as a result of inexperienced operational
personnel operating
and setting up equipment, in that;
(1)  at the inspection site, the operation personnel had not been
familiarized with all the instructions in documentations and the
operation manual provided by Buhler.
(2)  at the inspection site, die setting procedures had not been
established for the set up people.
(3)  at the inspection site, employees unable to read or write
English had not been explicitly shown existing hazards nor given
special instructions.

(a)  the hazard of being crushed by the machine, in that at the inspection
site, an
employee was directed to operate the #10 Buhler die cast machine and
insert magnets and
counterweights into the die while the machine was programmed in the
automatic mode.  The
Buhler manual safety regulations strictly prohibit manual extraction,
insertion, spraying or
lubricating during automatic operation.
