Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to:
(a) the hazard of being struck by a moving D8R Caterpillar tractor. On or
about 08-17-
98, an employee who was marking the route for his trenching machine, was
run down and then
run over by a Caterpillar tractor, about 1/4 mile from Sun City Blvd.
Among other methods,
one feasible and acceptable method to correct this hazard is to follow the
instructions in the
tractor's operations and maintenance manual. These are:
(1) To make sure the area is free of personnel before starting the engine.
(2) Clear all personnel from the machine and area before starting the
engine.
(3) Be satisfied that no one will be endangered before moving the machine.
and/or in the alternative:
29 CFR 1926.20(b)(1) The employer did not maintain such programs as may be
necessary to
comply with this subpart:
(a) The safety program was not revised annually and did not include
guidelines for the
safe operation of the D8R Caterpillar tractor. One method of abatement
would be to follow the
tractor manufacturer's operations manual, usually located in the pocket
behind the operator's
seat.
