General-duty citation text
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of fire, third degree burns, and explosion from molten asphalt. Hazards exist due to the manual stirring and dispensing of the molten asphalt by using a hand held ladle: a.Spray Booth for Potting --- On or about 01/21/1997 employees were exposed to the hazard of burns from molten asphalt when required to manually stir and dispense molten asphalt, that was contained in a open top one gallon pail, by using a hand held ladle, and a fire occurred resulting in an employee sustaining third degree burns to his right hand. ABATEMENT NOTE: Among other methods, one feasible and acceptable abatement method to correct this hazard is to install, use, and maintain an electrically heated mixing and dispensing tank for heating, stirring and dispensing molten asphalt.
