Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fires/explosions: a.Sulfur Treat Area - The tanks that are pressurized at greater than 15 psig were not equipped with rupture disks. Also, the ventilation system was not heated to ensure that sulfur does not condense in the vent lines. The tanks were not equipped with a gaseous fire extinguishing system, or in the alternative, were not arranged such that they could be rapidly sealed in the event of a fire. ABATEMENT NOTE: Among other methods, one feasible and acceptable method of abatement would be to comply with the requirements of National Fire Protection Association (NFPA) 655 - Standard for Prevention of Sulfur Fires and Explosions.
