Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to hazards of being struck by, caught between, crushed and/or
a fall:
a.Jobsite -- The bucket of a Caterpillar IT 38F was used as a work platform
to elevate workers from the ground to an elevated location so they could
remove a plate glass window for salvage.
b.Jobsite -- The bucket of a Caterpillar IT 38F Loader was used to
transport
workers and materials from point to point on site.
ABATEMENT NOTE:  One feasible and acceptable abatement method, among
others, to
correct this hazard is to provide a safe alternative access to the plate
glass windows by use of
an aerial lift.
