Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer
did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to hazards of oxygen deficiency and/or toxic atmospheres:
a. 5/5/98-5/6/98 Airport Rd., Concord, N.H.- An employee was exposed to
potential oxygen deficient and/or toxic atmospheres during an entry of the
confined space (manhole) without benefit of a fully implemented confined
space
program, in that the following elements were not addressed:
(1) 5/5/98-The atmosphere of the space was not monitored prior to entry.
(2) 5/6/98- The atmosphere of the space was tested with a monitor that had
not
been properly calibrated.
(3) Appropriate retrieval equipment was not used by the entrant.
(4) A confined space entry permit was not executed.
(5) An adequately trained attendant/standby person was not available at the
opening.
Attendant duties include but are not limited to: (a) Provide standby
assistance
to occupants
entering the confined space (b) Direct occupants to exit the confined
space when any
irregularities are observed (c) Initiate evacuation and emergency
procedures. (d) Monitor for
conditions that could adversely affect the entry.
Abatement Note: Among other methods, one feasible and acceptable method to
address these
hazards is to develop, implement and enforce a written confined space
entry program in
accordance with American National Standard Institute's Standard for
Confined Spaces (ANSI
Z117.1,1989).
