Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to hazards of falling off an excavator due to provisions to carry passengers other than the operator were not available on the excavator: a.Route 3, Access Road #70 - A Caterpillar 330B excavator bucket was used to transport an employee into and out from an excavation, on or about 12/8/98. ABATEMENT NOTE: Among other methods, one feasible and acceptable means of abatement would be to prohibit employees from riding in the bucket of the excavator. (Abatement certification is not required.)ion
