Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being crushed by falling or sliding soils during the collapse of the excavation: a.End of Mountain Road - Employees working in the excavation were not protected by a sloping or shoring system. ABATEMENT NOTE: Among other methods, on feasible and acceptable means of abatement would be to slope the excavation walls back at a slope of 1.5 : 1 or provide a protective system, such as a trench box or other approved means. Subpart P within 29 CFR 1926 should be used for guidance.
