T.C.A. 50-3-105(1):  The employer did not furnish employment and a place
of employment
which were free from recognized hazards that were causing or likely to
cause death or serious
physical harm to employees in that employees exposed to the hazard of
being infected with
mycobacterium tuberculosis through unprotected contact with patients who
were infectious or
suspected to be infectious with tuberculosis, in that there was no system
in place to identify
patients with suspected tuberculosis who were transported from the nursing
home to the hospital,
there was no medical surveillance program for these employees who
transported the patients
suspect tuberculosis and there was no worker education and training
program.
An example of such on 09/30/97 was, an employee interview revealed that
the employee
transported suspect tuberculosis patients from the local nursing home to
other locations such as
to the hospital.
Feasible abatement could include, but is not limited to requirements in
the
1994 CDC Guidelines
for Preventing the Transmission of Mycobacterium tuberculosis in
Health-Care Facilities which
could include the following:
Establishing a TB Control Plan in accordance with the CDC guidelines and
supplying
employees with protective equipment that would protect them when
transporting TB
patients.  The employer shall also assure that employees are trained on
TB.  When
transporting "suspected" patients a surgical mask shall be placed over the
patient mouth
and nose, if possible.  EMS personnel should wear respiratory protection
(minimum N-
95).  When feasible, the windows of the vehicle should be kept open and
the air
conditioning / heating unit should be set on a non-recirculating setting.
EMS personnel
should be included in a comprehensive PPD screening program and should
receive a
baseline PPD test and follow-up testing as indicated by the risk
assessment.  They should
also be included in the follow-up contacts of a patent with infectious TB
(The Ryan
White Comprehensive Aids Resource Emergency Act of 1990 mandates
notification of
EMS personnel after they have been exposed to infectious pulmonary
TB).onary
