General-duty citation text

T.C.A. 50-3-105(1):  The employer did not furnish employment and a place
of employment
which were free from recognized hazards that were causing or likely to
cause death or serious
physical harm to employees in that employees were exposed to the hazard of
being infected with
Mycobacterium tuberculosis through unprotected contact with inmates who
were infectious or
suspected to be infectious with tuberculosis in that there was no protocol
established for the early
identification of individuals with active TB, no medical surveillance
programs for employees at
the jail, no worker education and training program on the hazards of
tuberculosis, and no
negative pressure isolation rooms for housing inmates with suspected or
active tuberculosis, and
no respirator program for employees who transported inmates suspected of
having tuberculosis
in closed vehicles.
Feasible and useful abatement methods for reducing this hazard, as
recommended by the CDC
include, but are not limited to:
*Assign responsibility for a Tuberculosis Control Plan.
*Conduct a risk assessment as explained in CPL 2-2.45A which was provided.
*Conduct an annual community TB profile by contacting the local health
department to
determine incidence, prevalence, drug susceptibility patterns if any.
*Develop a Tuberculosis Control Plan using information in the TCA 4-3-1803
provided.
*Establish a protocol for referring patients who may have active TB to
collaborating
facility or hospital or outfitting an isolation cell so that it can be
maintained under
negative pressure and label the room properly with "halt, respiratory
isolation".
*Establish a respirator program.  Offer and enforce the use of respirators
with a minimum
N-95 respiratory protection factor, determine if employees are capable of
wearing
respirators, fit test them, and train them to use them correctly.
*Develop an education and training program as outlined in CPL 2-2.45A for
all employees
at the jail.
*Counsel and screen employees at the jail.  Ensure that TB skin test are
appropriately
provided to employees.
*Evaluate employees who may have signs or symptoms of tuberculosis or who
have been
exposed to a person with undiagnosed, unrecognized tuberculosis
disease.osis
