T.C.A. 50-3-105(1):  The employer did not furnish employment and a place
of employment
which were free from recognized hazards that were causing or likely to
cause death or serious
physical harm to employees in that employees were exposed to the operation
and use of defective
aerial lift equipment which upon failure could result in serious injury
and or death from falls
from elevations.
In that, aerial lift equipment in use had the following defects:
1) The bucket on vehicle #30 was cracked down two sides of the bucket
which could create a
bucket failure.  The bucket also had a missing piece which had been broken
off the top section
of the bucket.
2) Vehicle #28 had a loose operator control box, a damaged wire cable on
the boom, two
hydraulic hose leaks were observed, and a leak in the cylinder seal.
Among others, one method of feasible abatement for these defects would be
to replace the
damaged bucket, replace the operator control box, the damaged wire cable,
and perform
appropriate maintenance and repairs to eliminate the leaking hydraulic
hoses/seal.
