Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the risk of injury from the rollover of a fork truck when not wearing a seat belt: a.Facility wide - An employee was operating a Daewoo G25E fork truck. The employee was not wearing the seat belt that was provided on 2/13/02.
