Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to:
In the Shipping and Receiving Area the freight elevator was not equipped
with the following
safety devices, exposing the operator and other employees in the vicinity
of the elevator to the
hazards of falling into the elevator shaft or being struck by the elevator
car:
a) The freight elevator hoistway landings were not fully guarded and
enclosed to prevent
employees from falling into the hoistway opening or being caught under the
elevator
freight car as required by ASME A17.1-1996, Section 110, Rule 110.1.
b) Hoistway inter locks were not provided to prevent the elevator freight
car from being
operated until the elevator doors were closed on both levels of the
hoistway as required
by ASME A17.1-1996, Section 111, Rule 111.1b.
c) The freight elevator was not provided with a capacity and data plate
permanently
mounted in the elevator as required by ASME A17.1-1996, Section 207, Rule
207.3a.
d) A sign was not placed in the elevator car reading "This is not a
passenger elevator.
No persons other than the operator and freight handlers are permitted to
ride on this
elevator", as required by ASME A17.1-1996, Section 207, Rule 207.5a.
e) A data plate placed in plain view and securely mounted to the elevator
was not
provided that indicated the A17.1 code was (is) used for inspection and
test of the
American National Standard Institute as required by ASME A17.1-1996,
Section 215,
Rule 215.1.
Among other methods, feasible and acceptable abatement method to correct
these hazards are
as follows:
a) Install full length enclosure doors having an appropriate fire rating
as per the ASME
standard.
b) Install electrical interlocks on both elevator doors on both levels to
prevent the
elevator from operating until all doors are closed and locked.
c),d), & e) Install data plate(s) required by this ASME standard.
