Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to heat stress conditions in excess of ACGIH recommendations:
a) In the late afternoon and early evening of 7/23/99, the two chefs
working in the broiler, stove
and oven area of the upstairs kitchen were exposed to a wet bulb globe
temperature (WBGT)
of between 88 to 102 degrees Fahrenheit while working in the area
immediately in front of the
stove, oven and broiler.  These employees, while performing worktasks of
moderate work load,
were continuously working in the area without breaks for as much as 45
minutes or more at a
time.  The ACGIH recommends a work rest regimen of 25work and 75rest
at WBGT of
88 degrees Fahrenheit.
Feasible and acceptable methods of abatement of this hazard include, but
are
not limited to the
following:
1) Providing greater air movement in the chef's work area (in front of the
stove,broiler...etc)
2) Providing cooler, fresh air intake into the cooking area of the kitchen.
3) Providing air conditioning to the kitchen.
4) Providing more frequent rest breaks to the chefs.
5) Increasing the amount of air exhausted by the hood over the stove, and
broiler area.
