Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing injuries by the moving elevator car between the floors, wall openings, and gate due to the absence of an inside car gate/door and a substantial landing platform door. (a) Employees were allowed to ride in a freight elevator that was not properly converted into an acceptable passenger elevator. The employees were exposed to crushing injuries from the landing platform and moving elevator car at the gate and/or exposed to crushing injuries in the elevator car between floors and the wall openings. Among other methods, feasible and acceptable methods to correct this hazard; 1: Use the elevator strictly as a freight elevator allowing only freight handlers to ride in the elevator with a sign reading: "THIS IS NOT A PASSENGER ELEVATOR, NO PERSONS OTHER THAN THE OPERATOR AND FREIGHT OPERATORS ARE PERMITTED TO RIDE ON THIS ELEVATOR". Referenced by ANSI A17.1; Rules 207.4 and 207.5a. and/or 2: Follow the guidelines in ANSI A17.1 for the proper rules to convert a freight elevator into a passenger elevator. This would include the addition of properly installed inside elevator and landing gate/door of a minimum height of 6 foot with the appropriate limitation signs. ANSI A17.1; rules in section 110, rule 204.6c, rule 207.4, and rule 207.5a. Abatement Certification and Abatement Documentation required.
