The employer did not furnish to employees employment and a place of
employment which were
free from recognized hazards that were causing or likely to cause death or
serious physical harm
to employees in that:
Employees were exposed to being crushed or struck by uncontrolled loads
when the operator of
a Caterpillar 235 BH did not remain in the operator's seat and did not
keep the machine under
control.
At this worksite located at 6700 Heron Bay Blvd., on or about August 26,
1998, the employer
did not ensure that the operator of the excavator:
1) Remained in the operator's seat while operating the excavator.
2) Kept the machine in operation under control.
AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE METHOD TO
CORRECT THIS HAZARD IS FOR THE EMPLOYER TO ENSURE THAT THE
OPERATOR OF THE EXCAVATOR:
1) REMAINS IN THE OPERATOR'S SEAT WHILE OPERATING THE EXCAVATOR,
AND
2) KEEPS THE MACHINE UNDER CONTROL WHILE OPERATING THE
EXCAVATOR.
REFERENCE THE CATERPILLER OPERATION MANUAL FOR 235 AND 235B
TRACK-TYPE EXCAVATORS.
PLEASE NOTE:  CERTIFICATION OF ABATEMENT IS REQUIRED FOR THIS
VIOLATION.
