Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to hazards posed by suspended overhead loads: a) COMPOUNDING DEPARTMENT: ON 03/25/98 THE OVERHEAD HOIST LOCATED IN THE COMPOUNDING DEPARTMENT WAS OBSERVED ON SEVERAL OCCASIONS UNATTENDED WITH A SUSPENDED LOAD RAISED TO THE HOISTS MAXIMUM HEIGHT LIMIT IN THE AREA ABOVE THE CARBOY TILT TABLE. IN THE EVENT OF A FAILURE OF THE HOIST OR RIGGING, THE EMPLOYEE WORKING IN THIS AREA COULD BE SERIOUSLY INJURED IF STRUCK BY THE FALLING LOAD. AMONG OTHER METHODS, ONE FEASIBLE METHODS OF ABATEMENT WOULD BE TO INSTRUCT ALL EMPLOYEES OPERATING OVERHEAD HOISTS NOT TO LEAVE SUSPENDED LOADS UNATTENDED. ANSI B30-16, 1973, SPECIFIES SAFETY REQUIREMENTS FOR CRANES, DERRICKS, HOISTS,HOOKS, JACKS AND SLINGS, WHICH CONTAINS SPECIFIC OPERATING INSTRUCTIONS WHICH STATES "THE OPERATOR SHALL NOT LEAVE THE LOAD SUSPENDED IN THE AIR UNATTENDED UNLESS PRECAUTIONS ARE TAKEN".
