Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employee(s) were exposed to a hazard of being crushed by a three wheeled type fork truck after being thrown while turning because a restraint device was not being worn. A feasible and acceptable method to correct this hazard, among others, would be to wear a seat belt while operating the unit to prevent an employee from falling out in the case of an overturn. ESTABLISHMENT LOCATED AT 502 BOSTON POST ROAD IN SHREWSBURY, MA. 01545: WEST SIDE OF THE BUILDING PARKING LOT AND DRIVEWAY, CLARK BRAND 3 WHEEL TYPE FORK LIFT, WITH A POST ATTACHMENT, MODEL TMD- 55/TM-15S SERIAL NUMBER TM247-0341-6990FB. THE SEAT BELT WAS NOT BEING USED IN THAT IT WAS ATTACHED AROUND THE PERIMETER OF THE DRIVER'S SEAT.
