Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to injury from operation of a cardboard tube trimmer by
inadvertent startup of the
machine because of the location of the control box:
(a) TRIMMER DEPT./SECONDARY OPERATION --  MACHINE OPERATOR(S) WERE
EXPOSED TO THE HAZARD OF INADVERTENTLY STARTING THE MACHINE CYCLE
BECAUSE OF THE LOCATION OF THE CONTROL BOX WHICH WAS LOCATED
APPROXIMATELY BELOW THE DRUM SPINDLE WHERE THE EMPLOYEE OPERATED
THE MACHINE.
AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT
METHOD TO CORRECT THE HAZARD WOULD BE TO MOUNT THE CONTROL PANEL
IN AN EASILY ACCESSIBLE LOCATION WHEREBY THE OPERATOR COULD NOT
UNINTENTIONALLY RESTART THE CYCLE OF THE MACHINE. IN ADDITION TO
THIS FEASIBLE AND ACCEPTABLE METHOD OF ABATEMENT, THE EXISTING E-TOP
BUTTON WOULD BE REPLACED BY A E-STOP BUTTON WHICH HAS TO BE
MANUALLY RELEASED BY THE OPERATOR BEFORE INITIATION OF THE TRIMMER
MACHINE.ON
