Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being injured by the rotating blades of the granulator located in the cutting chamber: (a) MOLD DEPT. -- NO POSITIVE MEANS PROVIDED BY EMPLOYER TO REGULARLY INSPECT THE PORTABLE BALL & JEWEL SERIES MD 1212 GRANULATORS TO ENSURE THAT SAFEGUARDS ARE IN OPERATING CONDITION AND PROPER ADJUSTMENT, EXPOSING EMPLOYEE(S) TO POSSIBLE SEVERE LACERATIONS AND/OR AMPUTATION FROM ROTATING BLADES IN THE CUTTING CHAMBER. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD WOULD BE TO ESTABLISH AND FOLLOW A PROGRAM OF PERIODIC AND REGULAR INSPECTIONS OF GRANULATORS TO ENSURE THAT THE SAFEGUARDS ARE IN OPERATING CONDITION AND PROPER ADJUSTMENT AS PUT FORTH IN THE AMERICAN NATIONAL STANDARD FOR PLASTICS MACHINERY - GRANULATORS, PELLETIZERS, AND DICERS USED FOR THE SIZE REDUCTION OF PLASTICS -- CONSTRUCTION, CARE, AND USE. B151.11- 1982, SECTION 3.1.4, INSPECTION AND MAINTENANCE RECORDS, AS STATED THAT IT SHALL BE THE RESPONSIBILITY OF THE EMPLOYER TO ESTABLISH AND FOLLOW A PROGRAM OF PERIODIC AND REGULAR INSPECTIONS OF GRANULATORS, PELLETIZERS, AND DICERS TO ENSURE THAT SAFEGUARDS ARE IN OPERATING CONDITION AND PROPER ADJUSTMENT.
