Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a)At Battat, both warehouses, where employees were elevated to top shelving to either retrieve stock or to conduct inventory, by riding either on pallets that have been placed on the forks of lift trucks or by standing on the forks to heights of 12 feet and 17 feet, on or about 12/11/96. ABATEMENT NOTES Among others, one suitable method for abating this hazardous condition is: 1.Utilize only platforms designed for use elevating personnel with forklifts. These platforms must meet the requirement set forth in ANSI/ASME B56.1-1993, such as, buth not limited to, fall protection for employees. 2.Train all employees about the hazards of falls associated with improper elevating methods, and the proper application and use of safety platforms.
