Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employmnent and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to:
(a)An outside fire escape from a second story exit that did not conform to
the
requirements of NFPA Life Safety Code 101 in that it had a 13-inch step
from
the door to a platform outside the door, a 37-inch drop to the stair
landing
negotiated by a two-step ladder-like configuration, and one hand rail on
the
stairway on the left side descending, on or about 5/1/97.
A thorough search of OSHA standards has been conducted and no applicable
OSHA standard
exists.
A feasible means of abatement is:
Reconstruct the exit to conform with NFPA life Safety Code 101 so as to
eliminate hazards by:
1.Installing steps immediately outside the door, or
2.Building up the platform so that the difference in elevation is eight
inches
or less;
3.Installing steps to eliminate the ladderlike construction from the
platform
to the stair landing; and
4.Installing a second handrail on the open right side of the stairway,
descending.
