Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a)On or about 11/25/97, an employee was observed driving a Nissan Model CPH01A10V Forklift (Chassis No. CP401920450) with the restraint device not being used, thereby exposing the employee to serious injury as a result of entrapment of the operator's head and/or torso between the truck and the ground in the event of a tipover. ABATEMENT: One feasible means of abatement, among others, is to enforce the usage of seat belts on all forklifts equipped with them. ABATEMENT CERTIFICATION IS REQUIRED FOR THIS ITEM.
