Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a potential for smoke inhalation during fire conditions: (a) Location - Conveyor Area: On or about 11/23/99, smoke barriers were not provided at the vertical openings for the conveyors from the first floor through the third floor. (b) Location - Top of Stairs at end of room 12: On or about 11/23/99, a door was not provided at the stairway to prevent smoke from entering the emergency exit stairwell. (c) Location - Bottom of stairs at room 8: On or about 11/23/99, a door was not provided at the stairway to prevent smoke from entering the emergency exit stairwell. (d) Location - Second floor main stairway: On or about 11/23/99, doors were not provided at the stairway to prevent smoke from entering the emergency exit stairwell. (e) Location - Door to first floor near main entry: On or about 11/23/99, the door was propped open at the stairway and would not prevent smoke from entering the emergency exit stairwell. Among other means, one feasible means of abatement would include providing conveyor opening covers or enclosures and self-closing fire doors at all emergency exit stairways to prevent smoke from entering emergency enclosure and from smoke travelling quickly from floor to floor.
