Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falls while working on a material racking system: (a) Location: Warehouse On or about 09/28/00, employees were exposed to a fall when leaving the confines of the lift platform to adjust material on the racking. Among other methods, feasible means of abatement would be to: 1) Utilize a vehicle for lifting employees which is equipped with restraining devices(s) and meets the requirements set forth in ANSI/ASME B56.1-1993. 2) Train employees on safe use of lifting equipment and fall hazards. OR IN THE ALTERNATIVE 29 CFR 1910.132(a): The employer did not provide personal protective equipment wherever necessary, by reason of process hazards or environment encountered in a manner capable of causing injury or impairment in the function of any part of the body through physical contact: (a) Location: Warehouse On or about 09/28/00, the employer did not provide personal protective equipment such as personal fall arrest system for employees working in a racking system approximately 11 feet above the ground.mately
