Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to:
Employees working to collect traffic control signs, following the
completion of an asphalt repair
job, were exposed to the recognized hazard of "falling from an elevated
position" or being
"struck by" when they fell from a moving vehicle.  The employer did not
take adequate
measures to control employee(s) exposure, in that:
The employer failed to ensure employees utilized appropriate facilities for
transporting passengers.
The potential for "falling from an elevated position" or being "struck by"
was demonstrated by
the following instance:
On or about August 5th, 1998 employees fell from a moving truck while
collecting traffic control signs.
Among other methods, recognized and feasible means of abatement to correct
this hazard
include, but are not limited to:
a)  Instructing the employees to ride in the club cab between pick-up
points when
collecting traffic control signs.  This method of transportation was
available at the
time and place of the accident.
b)  Employees should be informed of disciplinary consequences for failure
to
comply with this rule.
c)  Full communication of company safety policies and consequences for
failure
to comply throughout all levels of organization.
