Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) Crushing hazards when walking under formwork that was being loaded. Employees accessing the 3rd and 4th floor during concrete placement on the 4th floor were under formwork that was in the process of being loaded or had just been loaded. "AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD IS...." 1. Providing points of access in positions where employees do not need to walk under formwork that will be loaded, 2. Erect safety signs and barricades to keep unauthorized personnel clear of area in which erection, concrete placing, or stripping is under way as stipulated by the American Concrete Institute, "Guide to Formwork for Concrete", ACI 347R-88, 3.1(a).
