Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: The hazards of being crushed by the force of bulls or being entrapped and crushed by the swinging gate forced open by bulls where gates latches are broken and chains with snaphooks allow bulls to escape from containment. AMONG OTHER METHODS, FEASIBLE AND ACCEPTABLE ABATEMENT METHODS TO CORRECT THIS HAZARD INCLUDE: 1. Installing gate latches which cannot be defeated by the bulls, 2. Installing stops for the gates which cannot be defeated by the bulls, 3. Have personal protective equipment in the form of steel cages in which employees may be removed from hazard while performing their cleaning duties, 4. Use trained herd dogs to control bull movements, 5. Redesign stall configurations so that employees are not exposed to bulls. * Abatement verification in the form of photos, videos or other documentation is required for this citation.
