Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to hazards associated with contacting underground lines while operating an Allied Hole-Hog, Model 2000C without knowing the location of the underground lines: Among other methods, one feasible and acceptable abatement method to correct the hazard is follow Wisconsin State Statute 182.0175(2)(am)(1): "Provide advance notice of not less than 3 working days before the start of the non-emergency excavation to the one-call system." and also follow Wisconsin State Statute 182.0175(2)(am)(4): "Provide a repeat notice to the one-call system if marks are destroyed or covered by excavation site activities, if the excavation does not start within 10 days of the scheduled start date or if excavation is interrupted for more than 10 days."
