Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the condition(s) listed below: 15 miles east of Stratford, TX., on Hwy 15, at Walter Lasley & Sons, Inc., Feed Lot, on or about July 31, 1997, at around 1445 hrs., the Arktite, 30 amp, APR3455, connector receptacle, which had been installed by two Deakin Electric employees on 6/5/97, was not installed in a workman like manner, in accordance with NFPA 70-110-12, 1996, as evidenced by the following deficiencies: 1) The set screw, which locks the receptacle's to metal case sections together had not been tightened. This allowed movement of the two case sections, allowing tension to be placed on the joints and connectors inside the receptacle. Additionally, the receptacle was not sealed, defeating the water tight capabilities of the unit. 2) The metal case had not been grounded internally. 3) One conductor had not been properly connected and when a slight force was applied the wire pulled out of the terminal. Manufacturer's specifications call for 30 inch pounds of torque and no larger than a #8 wire. The wire used appeared to be #6 and was larger than the terminal hole. 4) The receptacle had been installed on a hard service flexible electrical cord within 4 feet of a cut in the cord's outer insulation, which exposed inner conductor's outer insulation. This was not a new cut as the inner insulation was deteriorated. This exposed employees to the hazards associated with electrical shock. Among other feasible and acceptable methods for abatement would be to train employees on requirements of NFPA 70, National Electrical Code, and to follow manufacturer's written instructions for installation of plugs and receptacles.
