Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the condition(s) listed below: A) Employee was observed smoking next the rig, this area was posted as non smoking area. Smoking next to the rig is prohibited in accordance with API RP 54, section 6.1.2 "Smoking shall be prohibited at or in the vicinity of operations that constitute a fire hazard....". Smoking or open flames could result in a fire and or explosion as a result of the gases which could be ignited.n
