Section 5(A)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: Birdsong Peanuts, Inc., 17 miles west of Seminole, TX., on highway 62/180, in Gaines County, TX., for the period of time up to and including June 8, 1999, at around 1700 hrs: The personal protective equipment which was provided by the employer for employees to use was found to be defective. Specifically, the latching device on the fall protection lanyard's hook, would not close automatically when released. Equipment apparently had not been inspected in accordance with ANSI Z359.1-1992, paragraph 6.1 Inspections, 6.1.1 - "Equipment shall be inspected by the user before each use and, additionally, by a competent person other than the user at intervals of no more than one year." This exposed employees to hazards and injuries associated with falls from heights of as high as 55 feet because of "roll-out".

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the condition(s) listed below: Birdsong Peanuts, Inc., 17 miles west of Seminole, TX., on highway 62/180, in Gaines County, TX., for the period of time up to and including June 8, 1999, at around 1700 hrs: Employees had not received adequate training on use of fall protection equipment which the employer had provided for use by employees when the employees were required to work from heights of as much as 55 feet. Employees had not been trained in accordance with ANSI Z359.1-1992, paragraph 7.3 Training -"Prior to work requiring PFAS (Personal Fall Arrest Systems), users shall be trained by a competent person to select, inspect, use, store and maintain the equipment according to the requirements of this standard and the manufacturers' instructions. This exposed employees to hazards and injuries associated with wear and use of defective personal protective equipment.
