Section 5(A)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to:
Tip Top Amusements, 4th & O Street, Lubbock, TX., for the period of time
up to and including
September 20, 1999, at around 1215 hrs:  The fall protection equipment
provided by the
employer for employees to use while working from unguarded heights of as
much as 63 feet
above ground level, did not meet the current criteria of system components
for a personal fall
arrest system:
1. The employer had provided a "Lineman's" climbing belt as a component of
a personal fall
arrest system.  As of January 1, 1998, the use of "Body Belts" is limited
to use as a positioning
device and is no longer approved for components of a personal fall arrest
system.
2. The employer had provided a lanyard which was constructed of leather as
a component of a
personal fall arrest system.  In accordance with ANZI Z359.1-1992,
paragraph 3.2 Component
and Element Requirements, 3.2.3 Lanyard Components, 3.2.3.1 "Rope and
webbing used in the
construction of lanyards shall be made of virgin synthetic material having
strength, aging,
abrasion resistance and...superior to polyamids."
3. The employer had provided a lanyard which was equipped with single
action non-locking
latches on the hooks as a component of a personal fall arrest system.  In
accordance with ANZI
Z359.1-1992, paragraph 3.2 Component and Element Requirements, 3.2.1
Connectors, 3.2.1.4 -
"Snaphooks and carabiniers shall be self-closing and self-locking and
shall be capable of being
opened only by at least two consecutive deliberate actions."
4. The employer had provided a "Lineman's" climbing belt which showed
evidence of
deteriorating leather, stitches were pulled loose and rivets were
corroded.  The belt apparently
had not been inspected in accordance with ANSI Z359.1-1992, paragraph 6.1
Inspections, 6.1.1
- "Equipment shall be inspected by the user before each use and,
additionally, by a competent
person other than the user at intervals of no more than one year."
This exposed employees to hazards and injuries associated with falls from
heights of as high as
63 feet because of improper or defective personal fall arrest components.

Tip Top Amusements, 4th & O St., Lubbock, TX., for the period of time up
to and including
September 20, 1999, at around 1215 hrs:  Employees had not received
adequate training on use
of fall protection equipment which the employer had provided for use by
employees when the
employees were required to work from heights of as much as 63 feet.
Employees had not been trained in accordance with ANSI Z359.1-1992,
paragraph 7.3 Training
-"Prior to work requiring PFAS (Personal Fall Arrest Systems), users shall
be trained by a
competent person to select, inspect, use, store and maintain the equipment
according to the
requirements of this standard and the manufacturers' instructions.
This exposed employees to hazards and injuries associated with wear and
use of defective
personal protective equipment.
