Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the condition(s) listed below:
Warrick Furniture Company, Inc., 627 Ash, Plainview, Texas, 79072; for the
period of time
up to and including 10:30 hours August 18, 2000 employees in the use of
powered industrial
trucks were exposed to fall hazards while operating a stockpicker
identified as "Crown"
Stockpicker, High Lift Truck, Model #30SP36TT, Serial #1A131687.
a)  An employee operating the Stockpicker was storing cartoned chairs in a
storage rack
approximately 13 feet high in the warehouse.  The operator was not using a
safety harness and
lanyard nor was an alternative form of fall protection being used.
b)  An employee riding the platform was working from the far end of the
platform, helping to
place cartoned chairs in a storage rack approximately 13 feet high in the
warehouse.  The
employee was not using a safety harness and lanyard nor was an alternative
form of fall
protection being used.
This allowed the employee (b above) working from the platform to fall ten
feet from the
platform surface, striking the head on the concrete floor, causing trauma
to the head which
resulted in death.
Feasible abatement methods include, but are not limited to:
a)  As noted in the warning label attached to the inside of the operators
cab:  Attach safety belt
and tether before operating truck.
b)  As noted in the Operators safety manual for the Crown Stockpicker:  As
per Crown
Stockpicker Training Manual Model #30SP36TT; "The operator harness
provided
with your
truck is designed to protect you, but it won't do any good unless you use
it."
