Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of falling from a work platform attached to an all terrain forklift: Country Inn Suites - The employer elevated an employee on a platform set on the forks of an all terrain forklift. The platform was not secured to the lift, the employee did not wear a harness and lanyard and the platform did not have a guardrail on the front side. One feasible means to abate this condition is to follow the recommendations set forth in ASME B56.6a-1994, section 5.15.
