Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of falling from site built ladders: Employees were exposed to falling from site built ladders that were not constructed in accordance to the requirements in ANSI A14.4-1979 Safety Requirements for Job Built Ladders. The ladder being used to enter and exit the excavation did not have spacer blocks between the cleats and the cleats were not properly nailed to the rails.
