Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish
a place of employment which was free from recognized hazards that were
likely to cause death
or serious physical harm to employees. Employees were not evaluated for
physiological
limitations for respirator usage.
E & H Restoration's respirator program required "all personnel required to
wear
respiratory protection shall be medically certified by a competent
physician to wear and
use such equipment."
Among feasible means of abatement would be to comply with the 1992 -
American
National Standard for Respiratory Protection and,
1.Have a physician determine whether or not an employee has any medical
condition that would preclude the use of respirators and,
2.Have the respirator program administrator advise the physician of the
following
conditions to aid in the determination of the medical evaluation required:
a.type of respirator for normal use
b.typical work activities, environmental conditions, frequency, and
duration
of use,
c.hazards for which the respiratory equipment will be worn.
