Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment or a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees. The employer did not have an effective safety and health program which included training in hazard recognition to avoid unsafe conditions that may be present on a construction site. Feasible abatement methods include, but are not limited to: 1) Instruct managers conducting job site visits in hazard recognition and avoidance of construction hazards. 2)Develop a set of accident prevention rules to be followed by these managers. 3)Ensure that managers have access to personal protective equipment such as hard hats.
