General-duty citation text
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by moving trucks and other heavy equipment: On or about 4/18/97 employees cleaning and sweeping recycling paper and debris were exposed to moving trucks and equipment to include the employer's own trucks and heavy machinery as well as container trucks belonging to outside vendors and municipal refuse collection trucks. This condition occurs when employees working on foot are sent to do sweeping into areas where vehicles and machines are moving quickly, or backing up and maneuvering to move material. This activity takes place on day and night workshifts and under low visibility conditions as observed on 4/18 at night in areas with low lighting while raining. Exposure areas are the facility driveways, paved yard areas, and on floor areas inside the plant building "tipping floors". The condition was observed on 4/18/97 during the PM workshift, and on 4/22/97, and 8/25/97 day shifts. Among others, feasible methods to eliminate or materially reduce this hazard are to: 1) Remove pedestrian traffic from the "tipping floor" and other high traffic areas where employees are exposed to motorized traffic. 2) Demarcate and segregate pedestrian walkways using high visibility paint, cones, stanchions and/or jersey barriers. 3) Employ mechanical sweepers. 4) Install "speed bumps" at various locations including inside/outside maintenance bays in order to slow traffic. 5) Implement water cannons or alternate mechanized dust control systems at elevated areas throughout the facility. 6) Implement automatic tarping systems or its mechanical equivalent. 7) Enforce the plant 5 mph speed limit and "First Gear Only" rule. 8) Reroute, re-schedule or otherwise modify traffic flows to ensure pedestrian safety to the extent that engineering controls or other work practice controls are not effective in removing the hazard. Repeated Violation Note: Waste Management of New York, Inc. was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard which was contained in OSHA Inspection Number 300612579, Citation Number 1, Item 1, issued on 12/10/96 with Final Order Date 01/07/97.
